Flowable Events & Webinars Terms & Conditions

The following terms and conditions apply to Flowable Events and Webinars and constitute a contract between Flowable AG and its affiliates (“Flowable”) and the participant (“You”) registering for the virtual Flowable webinars (hereinafter known as “the Event”). By registering for the Event You confirm You have read and agree to comply with these terms and conditions (hereinafter known as “Terms”). Prior to Your registration, You must acknowledge and accept the Terms contained herein. Should You not wish to accept the Terms You should not register.

Fees

The event doesn’t require You to pay any attendance fees.

Intellectual Property

All Event materials, videos, images or content are copyrighted by Flowable, and Flowable retains all intellectual property rights therein. You agree to not reproduce or distribute Event materials to any third party, for any purpose, without the written consent of Flowable. Subject to the foregoing, registrants may retain copies of the materials for their own personal use.

Registration Process and Technical Requirements 

In order to register You need to provide Flowable with some information about yourself such as your first and last name, job title, e-mail address, company, region and/or chosen password.

Once confirmed you have read and accept our Event conditions of use and privacy notice, your participation will be submitted to us and you will be able to attend the Event.

You are responsible for any technical requirements needed to access the virtual Event platform, website or app made available by Flowable, in order to facilitate Your participation in a virtual Event. 

Website and Links 

The virtual Event platform and associated Flowable websites may link to other websites and networking tools provided for the convenience of the participants. The contents of these websites are maintained by their owners, for which Flowable takes no responsibility. Flowable  shall have no responsibility or liability for the contents of or use of information contained in any website linking to this website.

Virtual event

Any posts, messages or other information You supply or submit to the Event platform will be considered non-confidential and You hereby consent to and authorize Flowable to use, copy, or distribute and disclose any such post, message or information to third parties. Flowable  reserves the right to edit or remove any post inside of the virtual Event platform.

Flowable may at any time refuse access, remove or block any person from the virtual Event platform who fails to comply with these terms and conditions. You agree to comply with all reasonable instructions issued by Flowable to participate in the Event. 

Miscellaneous

Flowable reserves the right to modify or amend these terms and conditions at any time, which changes shall take effect without notice. Please make sure to read them regularly.

Media and interactions during the On-site and Virtual Event

Flowable may take photographs and videos of the speakers or You during the Event. Flowable may also use social media (e.g. Twitter/Youtube/Linkedin) to: (i) post real-time photos and videos to its social media feeds and website; and (ii) use and display select video or photographic material for marketing and promotional purposes (iii) use any comments or feedback You provide while engaging with other Flowable Con participants, sponsors and speakers. 

By agreeing to these Terms, You grant Flowable the perpetual, global, right to use, modify and distribute Your image/likeness free of charge as it sees fit for promotional and advertising purposes. 

Disclaimer

Flowable may at any time, with or without giving notice, in its absolute discretion and without giving any reason, change, cancel or postpone the Event, change any of the published particulars, or withdraw any invitation to attend.

Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL FLOWABLE NOR ANY OF ITS OFFICERS, EMPLOYEES, AGENTS, MEMBERS OR REPRESENTATIVES BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA, LOST REVENUE OR PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, DIRECT, INDIRECT, OR PUNITIVE DAMAGES ARISING FROM THE USE OF FLOWABLE’s EVENT PLATFORM(S), HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF CUSTOMER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE PARTIES ACKNOWLEDGE THAT THIS IS A REASONABLE ALLOCATION OF RISK.

Warranties

TO THE EXTENT PERMITTED BY THE APPLICATION LAW, FLOWABLE DISCLAIMS ALL WARRANTIES OR CONDITIONS, EITHER EXPRESS OR IMPLIED, OR ANY PART OF THEM IN RESPECT OF ANY ASPECT OF THE EVENT OR ANY RELATED EVENT MATERIALS. YOU ACKNOWLEDGE AND AGREE THAT IN ACCEPTING THESE TERMS YOU HAVE NOT RELIED ON ANY REPRESENTATION OR WARRANTY THAT IS NOT EXPRESSLY INCLUDED IN THESE TERMS AND YOU AGREE THAT YOU SHALL HAVE NO REMEDY IN RESPECT OF ANY MISREPRESENTATION WHICH HAS NOT BECOME A PART OF THESE TERMS.

Force Majeure

Flowable shall not be held responsible or liable for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, earthquakes, hurricanes, unseasonably extreme inclement weather, strikes, labor disputes, inability to secure sufficient labor, civil, governmental or military authority, government requisitions, restrictions or regulations on travel, facility availability, commodities or supplies, civil disturbance, transportation, acts of God, acts of terrorism or threats of terrorism, acts of war, accidents, epidemics, disasters, or any other cause beyond its reasonable control.  In any such event, Flowable  may postpone, reschedule or cancel the event without liability on the part of Flowable. In the event the Event cannot be held or is postponed pursuant to this section, Flowable shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. 

Contracting Flowable entity, Governing law and venue

The law governing this Contract is the Swiss law, and the courts that have jurisdiction over any such dispute or lawsuit are in Bern, Switzerland.
